Terms of Service

Last updated:

These Terms of Service ("Terms") govern your use of Bookingpod, the restaurant reservation, event, and ticketing platform operated by Clint Labs ("Bookingpod", "we", "us"). Bookingpod includes this website, the public restaurant booking and event pages, the operator application, and related emails and services (together, the "Service").

By creating an account, accepting reservations or ticket sales through Bookingpod, or making a reservation or ticket purchase, you agree to these Terms. If you use Bookingpod on behalf of a restaurant or other business, you confirm that you are authorized to bind it, and "you" includes that business. If you do not agree, do not use the Service.

1. The Service

Bookingpod lets restaurants ("Businesses") publish a booking page, configure availability and capacity, manage reservations, dining areas, tables, and staff access, and, where enabled, create events and sell or issue tickets. Guests can view availability and book or buy tickets without creating an account.

We continuously improve the Service and may add, change, or remove features. Features labelled "early access", "beta", or "coming soon" may be incomplete, may change, and are provided without any commitment that they will become generally available.

2. Organizations and accounts

A Business is set up within an organization account. Each Business keeps its own settings, public page, availability, reservations, events, and guest information. Organization operators may give managers and staff accounts access limited to specific Businesses and functions.

  • You must be at least 18 years old and provide accurate, current information.
  • Each account is for one person. Do not share logins. You are responsible for all activity under your organization's accounts, including the actions of your staff.
  • Keep your credentials confidential and tell us promptly at business@clintlab.com if you suspect unauthorized access.
  • You must remove access for staff who no longer work for you.

3. Reservation rules for Businesses

Because fees depend on reservation outcomes, every Business must keep an accurate reservation record. The Service enforces these rules, and you agree to follow them:

  • Every reservation counts unless it is cancelled in time or is a no-show. A reservation whose time has passed is treated as completed unless staff cancelled it before its start time or marked it as a no-show within the correction window. Leaving a reservation open does not avoid fees.
  • Record what really happened, during service. Mark arrivals, completions, and no-shows truthfully and promptly. Marking a guest who dined as a no-show is a breach of these Terms.
  • Corrections close 12 hours after a reservation ends. After that, the reservation is locked, and any disagreement goes through our dispute process.
  • A reservation cannot be cancelled after its start time. If the guests did not arrive, mark it as a no-show (possible from 15 minutes after the start). A seated reservation cannot be cancelled or marked as a no-show.
  • After the start time, guest details, party size, date, and time cannot change; you may still seat the party, assign tables, complete the reservation, or mark a no-show.
  • The booking source is permanent. Online reservations cannot be converted into staff-entered reservations.
  • Do not move online bookings off the online channel, for example by cancelling an online reservation and re-entering the same guest as a staff reservation, or by completing it outside Bookingpod, to avoid online booking fees.
  • Do not create test or fake reservations in a live Business. Testing takes place in a separate test Business agreed with us.

Bookingpod keeps a permanent history of who changed each reservation and when. We monitor no-show rates and restaurant cancellations of online reservations, may ask for supporting evidence, and may charge reservations that we reasonably find were recorded incorrectly.

4. Fees and payment

Fees are those of the plan you choose, as shown on our pricing page or in a written agreement signed with us, which prevails if it differs. Unless stated otherwise, prices are in U.S. dollars and exclude taxes, which you are responsible for.

  • Each plan has a monthly fee, a number of included online bookings, and a fee for each additional completed online booking. Only online bookings made through your Bookingpod booking page, link, or QR code count, and only once they are completed as defined in Section 3. Cancelled-in-time, rejected, and duplicate reservations and genuine no-shows are not charged.
  • Reservations entered by your staff, such as phone and walk-in bookings, are free and unlimited on every plan.
  • Ticket fees apply per paid ticket. Payment-processor fees are separate from Bookingpod fees.
  • Free online bookings, such as the first 50 on Pay-as-you-Go, apply as described in your plan. Plans do not change automatically; you choose when to change plan.
  • You will receive a statement of billable items. Questions about a statement must reach us within 30 days of the statement date.
  • We may change our prices with at least 30 days' notice. Changes do not apply to periods already billed.
  • If payment is overdue, we may suspend online booking and ticket sales after notice.

5. Events and tickets

When a Business sells or issues tickets through Bookingpod, the Business is the organizer and seller of the event and is responsible for holding it as described, admission, accessibility, applicable permits and laws, and its refund and cancellation policy. Paid tickets are processed by Stripe, and Stripe's terms apply to payments. Bookingpod does not hold event funds on behalf of guests except as part of the payment flow provided by Stripe.

Tickets are personal access credentials. Ticket links and QR codes should not be shared publicly; anyone presenting a valid ticket may be admitted.

6. Terms for guests

When you book a table or buy a ticket, your reservation or purchase is with the Business, not with Bookingpod. The Business sets its own availability, party limits, dining duration, house rules, and cancellation policy, and is responsible for your visit.

  • Provide accurate contact details. We send reservation and ticket information to the email address you give us.
  • A reservation is confirmed only when the Service shows a confirmation. Availability shown before that is an estimate and may change.
  • Do not make reservations you do not intend to keep, under a false name, or on behalf of others for resale.
  • To change or cancel, contact the Business directly unless the Service offers you a way to do it online.

7. Guest data and privacy

Our Privacy Policy explains how we handle personal information. Businesses may use guest information received through Bookingpod only to provide and manage the reservation or event, and in compliance with applicable privacy and marketing laws. Reservation and ticket messages are operational; a Business must obtain any consent the law requires before sending guests marketing.

Guest information is kept separate for each Business and is not shared with other Businesses in your organization or with other organizations.

8. Acceptable use

You must not:

  • use automated means to make reservations, buy tickets, or collect data from the Service, or bypass bot protection, rate limits, or access controls;
  • probe, scan, or test the security of the Service without our written permission, or interfere with its operation;
  • upload unlawful, misleading, or infringing content, or content you do not have the right to use;
  • use the Service to send spam or to discriminate against guests unlawfully;
  • copy, resell, or reverse engineer the Service except as the law expressly allows.

9. Your content and our property

Businesses keep ownership of the content they provide, such as their name, descriptions, images, floor plans, and event details. You grant us a non-exclusive, worldwide, royalty-free license to host, display, and process that content to operate and promote the Service, for example to show your public booking page. You confirm that you have the rights needed to grant this license.

The Service, including its software, design, and the Bookingpod name and marks, belongs to us or our licensors. These Terms give you no rights to them other than to use the Service as permitted.

10. Third-party services

The Service relies on third-party providers, including hosting, email delivery, payment processing (Stripe), image hosting, and bot protection (Cloudflare Turnstile). Their availability is outside our control, and their own terms may apply to you.

11. Suspension and termination

You may stop using the Service at any time by contacting us. We may suspend or end your access, with notice where reasonable, if you breach these Terms, do not pay fees when due, create risk for guests or the Service, or if the law requires it. Fees for completed reservations and sold tickets remain payable after termination.

After termination we may keep records as described in our Privacy Policy, including reservation history needed for billing, disputes, and legal obligations.

12. Disclaimers

To the extent permitted by law, the Service is provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the Service will be uninterrupted or error-free, that emails will be delivered, or any number of reservations or guests. Businesses remain responsible for their premises, food, service, and events.

13. Limitation of liability

To the extent permitted by law, Bookingpod will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, or data. Our total liability for any claim relating to the Service is limited to the greater of the fees you paid us in the 12 months before the claim or US$100.

Some jurisdictions do not allow certain limitations, so some of them may not apply to you.

14. Indemnity

Businesses will defend and indemnify Bookingpod against third-party claims arising from their events, premises, services, content, use of guest data, or breach of these Terms.

15. Governing law and disputes

These Terms are governed by the laws of the State of Florida, United States, without regard to conflict-of-law rules. Disputes will be resolved exclusively in the state or federal courts located in Miami-Dade County, Florida, unless the law of your place of residence requires otherwise. Before starting a claim, please contact us at business@clintlab.com so we can try to resolve it informally.

16. Changes to these Terms

We may update these Terms. We will change the "Last updated" date and, for material changes, notify Businesses by email or in the app at least 30 days in advance. Continuing to use the Service after changes take effect means you accept them.

17. Contact

Questions about these Terms: business@clintlab.com.

If any part of these Terms is unenforceable, the rest remains in effect. These Terms, together with any signed agreement and our Privacy Policy, are the entire agreement between you and Bookingpod about the Service.
